What does the law say?


  • In several countries the sender must prove that the recipient has given the OPT-IN. The OPT-OUT option is required in most of the countries worldwide.
  • Different countries define the EU laws differently. The US has slightly different rules in every state. Other countries over the world are more or less the same. Common practice is that for unsolicited commercial e-mail messages private persons are asked for OPT-IN and general company addresses are asked to OPT-OUT. 
  • Prohibited: false or misleading subject lines and the use of a third party's Internet address or domain name without consent in order to make it appear that the third party sent the message and messages may not contain falsified routing information. 
  • Email messages must include the sender's legal name, street address, domain name, and valid return e-mail address or toll-free telephone number for opt-out requests, along with an opt-out mechanism. The sender must also maintain a functioning website for opt-out requests. In some US states a label ("ADV:") must appear at the beginning of the subject line. 
  • It is not the same in every country, yet being too precautious would not hurt.
  • In some countries acting against the rules may result in imprisonment.
